Terms of Service - Chapybara

These Terms of Service ("Terms") are a legal agreement between you ("User", "you", or "your") and Alpha System ("Company", "we", "our", or "us") regarding your use of the Chapybara API and related services ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Chapybara provides API access to domain, IP, and web technology intelligence, including but not limited to:

Domain intelligence (DNS, SSL, threat analysis)
IP intelligence (geolocation, ASN, proxy/VPN/Tor detection, risk scoring)
Web technology stack detection
Security analysis from multiple threat databases
API management tools, usage analytics, and technical support

We may update, modify, or discontinue any part of the Service at any time with or without notice.

2. User Accounts and Registration

2.1 Account Creation

To use the Service, you must create an account and provide accurate, current, and complete information. You must be at least 16 years old.

2.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials and API keys.
All activities that occur under your account.
Immediately notifying us of any unauthorized use or security breach.

2.3 Account Suspension

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, illegal, or harmful activities.

3. API Usage and Limitations

3.1 API Access

Subject to these Terms and the Chapybara API License, we grant you a limited, non-exclusive, non-transferable right to access and use our API.

3.2 Usage Limits

Rate Limits: API requests are subject to standard rate limits to ensure service stability.
Quota Limits: Daily request quotas apply to all users and reset daily at 00:00 UTC.

3.3 API Keys

API keys are confidential and must not be shared, embedded in public client-side code, or exposed publicly. You are responsible for the security of your keys.

4. License and Permitted Use

Your use of the Service is governed by the Chapybara API License, which is hereby incorporated into these Terms.

The Service is provided for non-commercial, personal, academic, and open-source projects only. Any and all commercial use is strictly forbidden and constitutes a material breach of these Terms. Failure to comply with the non-commercial restrictions in the Chapybara API License will result in the immediate and permanent termination of your account and access to the Service.

5. Acceptable Use Policy

5.1 Prohibited Uses

You must not use our Service to:

Use the Service for any commercial purpose whatsoever, as defined in the Chapybara API License.
Engage in illegal activities or violate any laws or regulations.
Harass, abuse, or harm others or violate their privacy.
Distribute malware, viruses, or other harmful code.
Conduct unauthorized penetration testing or vulnerability scanning.
Spam, phish, or engage in other deceptive practices.
Interfere with or disrupt our Service or infrastructure.
Reverse engineer, decompile, or attempt to extract our source code.
Resell or redistribute our Service without written permission.
Use automated tools to create fake accounts or abuse our systems.
Violate intellectual property rights of others.

6. Intellectual Property

We retain all rights, title, and interest in our Service, including software, algorithms, data compilations, trademarks, and copyrights.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR RELIABLE. YOU USE THE SERVICE AT YOUR OWN RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALPHA SYSTEM SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING IT. AS THE SERVICE IS PROVIDED FREE OF CHARGE, IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100 USD.

9. Indemnification

You agree to indemnify, defend, and hold harmless Alpha System from any claims, damages, or expenses arising from your use of our Service in violation of these Terms.

10. Termination

10.1 Termination by You

You may terminate your account at any time through your dashboard.

10.2 Termination by Us

We may suspend or terminate your access immediately if you violate these Terms.

10.3 Effect of Termination

Upon termination, your right to use our Service ends immediately. We may delete your account data subject to our data retention policies.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of Brazil, without regard to conflict of law principles.

11.2 Dispute Venue

Any disputes arising from these Terms shall be resolved in the courts located in Brazil.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy and API License, constitute the entire agreement between you and us.

12.2 Modifications

We may modify these Terms at any time. We will provide at least 30 days' notice for material changes. Continued use of our Service after changes take effect constitutes acceptance.
