1. Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you ("User", "you", or "your") and Alpha System ("Company", "we", "our", or "us") regarding your use of the Chapybara API and related services ("Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Chapybara provides API access to domain, IP, and web technology intelligence, including but not limited to:

Domain intelligence (DNS, WHOIS, SSL, threat analysis)
IP intelligence (geolocation, ASN, proxy/VPN/Tor detection, risk scoring)
Web technology stack detection
Security analysis from multiple threat databases
API management tools, usage analytics, and technical support

We may update, modify, or discontinue any part of the Service at any time.

3. User Accounts and Registration

3.1 Account Creation

To use the Service, you must create an account and provide accurate, current, and complete information. You must be at least 16 years old.

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials and API keys
All activities that occur under your account
Immediately notifying us of any unauthorized use or security breach
Using strong passwords and enabling two-factor authentication when available

3.3 Account Suspension

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, illegal, or harmful activities.

4. API Usage and Limitations

4.1 API Access

Subject to these Terms and your plan limits, we grant you a limited, non-exclusive, non-transferable right to access and use our API for legitimate business purposes.

4.2 Usage Limits

Rate Limits: API requests are subject to rate limits based on your subscription plan.
Quota Limits: Daily or monthly request quotas apply as specified in your plan.
Concurrent Connections: Limited based on your subscription tier.

4.3 API Keys

API keys are confidential and must not be shared, embedded in client-side code, or exposed publicly. You may create multiple API keys for different applications or environments.

5. Subscription Plans and Billing

5.1 Subscription Plans

We offer various subscription plans with different features, quotas, and pricing. Plan details are available on our pricing page and may be updated from time to time.

5.2 Billing and Payment

Subscription fees are billed monthly or annually in advance.
All payments are processed securely through Stripe.
Fees are non-refundable except as required by law.
You authorize us to charge your payment method for all applicable fees.
Failure to pay may result in service suspension or termination.

5.3 Plan Changes

You may upgrade or downgrade your plan at any time. Changes take effect immediately, and billing adjustments are prorated.

5.4 Price Changes

We may change our pricing with 30 days' notice. Changes will not affect your current billing cycle but will apply to subsequent renewals.

6. Acceptable Use Policy

6.1 Permitted Uses

You may use our Service for legitimate purposes including:

Security research and threat analysis
Website and application security monitoring
Fraud prevention and risk assessment
Network administration and monitoring
Academic research (subject to ethical guidelines)

6.2 Prohibited Uses

You must not use our Service to:

8. Intellectual Property

Support is provided based on your subscription plan. We aim to respond to support requests within reasonable timeframes but do not guarantee specific response times for all plans.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.
WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR RELIABLE.
YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALPHA SYSTEM, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

YOUR USE OF OR INABILITY TO USE THE SERVICE
ANY ERRORS, MISTAKES, OR INACCURACIES IN THE DATA
SERVICE INTERRUPTIONS, OUTAGES, OR SECURITY BREACHES
UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY

YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING IT.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM (OR $0 IF YOU HAVE NOT PAID).

12. Indemnification

You agree to indemnify, defend, and hold harmless Alpha System from any claims, damages, losses, or expenses arising from:

Your use of our Service in violation of these Terms
Your violation of any third-party rights
Any content you submit to our Service
Your negligent or intentional misconduct

13. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, internet outages, or acts of government.

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting us or using account deletion features in our dashboard.

14.2 Termination by Us

We may suspend or terminate your access immediately if you violate these Terms, fail to pay fees, or engage in prohibited activities.

14.3 Effect of Termination

Upon termination, your right to use our Service ends immediately. We may delete your account data subject to our data retention policies and legal requirements.

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of Brazil, without regard to conflict of law principles.

15.2 Dispute Resolution Process

Any disputes arising from these Terms or your use of our Service shall be resolved through binding arbitration in accordance with Brazilian arbitration laws, except where prohibited by local law.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding our Service.

16.2 Modifications
